WHEREAS the plaintiff filed a summons before the Magistrates Court in Bulawayo, Zimbabwe and whereas the said court issued the summons and particulars of claim for:

a) An order confirming dissolution of a customary law union

b) Sharing of the assets acquired during the union

c) Custody of minor children

Whereas the plaintiff applied for leave to serve you the summons by publication and accordingly the court having granted the said prayer.

YOU ARE HEREBY SUMMONED that within (14) days after service of this Summons upon you, enter or cause to be entered with me and also the Plaintiff’s Legal Practitioners at the address specified herein, an appearance to defend (i.e file a notice of intention to defend) to answer the claim of the Plaintiff herein.

In default of your so doing you will be held to have admitted the said claim, and the Plaintiff may proceed therein and judgment may be given against you in your absence.
