Before His Worship Setshegetso Mpho - Magistrate II, held on the 18th day of October 2024

UPON HEARING: Attorney Mr Motlogelwa C.T, no appearance for the Respondents and having read the documents filed of record

IT IS ORDERED THAT:

Draft Order is hereby made an Order of Court as amended.

1. This matter is urgent and the rules relating to services, forms and time limits are hereby dispensed with;

2. A Rule Nisi is hereby issued as amended returnable on the 23rd day of October 2024 at 08:30 hours calling upon the Respondents to show cause, if any, why the following orders should not be made final;

2.1 The Respondents be interdicted and restrained by ordering them to:

2.2 Forthwith take down all the offending Facebook publications in the Moeladilotlhoko Facebook page made in relation to the Applicant.

2.3 Forthwith, cease and desist from publishing any other material concerning the Applicant in relation to the matters complained of.

3 Granting leave and authorizing the Applicant under Order 8 of the Rules of the Magistrate Court, to serve the interim order by advertising same once in the Mmegi Monitor newspaper or any other newspaper with a similar country reach.

4 That paragraphs 2.1 to 2.3 shall operate as interim orders with immediate effect pending return date.

5 The Respondent is at liberty to anticipate a rule nisi by giving the Applicant and/or other party not less than twenty-four (24) hours notice.

6 That the Respondents pay the costs of this application on Attorney and own Client scale.
