Murder accused to walk free

The prosecutor in the case, Khumoetsile Tirelo has submitted that investigations are complete and they do not have enough evidence to try Seiketso. He however noted that the other two accused persons in the matter, Emmanuel Xolane and Moagisi Mosepele, will be committed before the High Court at their next mention on January 16th.

Tirelo said they could not commit the duo yesterday because the director of the Directorate of Public Prosecutions has not yet signed the requisite documents - which will also withdraw Seiketso from the charges. She also told the court that they will serve the two accused persons with the summary of statements.

Both accused persons, who now face a single count of murder, requested for a closer mention date.  The accused persons also agreed with the prosecutor to get the statements yesterday then wait for committal on January 16th.The accused appeared before Magistrate Ephraith Ndegwa since they were arraigned last year.  Xolane and Mosepele are currently remanded and are only likely to apply for bail when they start appearing before the High Court.

The accused persons are facing an offence that carries a maximum sentence of death or any other punishment if the court finds extenuating circumstances in the case.
