Sergeant denies assaulting ex-BCP man

Kutlwano police officer George Morebodi also denied in court yesterday that they had promised to release Fly after he recorded his confession statement.

'Fly was a humble man. We never promised to release him after he made his confession. Looking at the gravity of the offence there is no way we could have released him,' Morebodi said. Fly is alleged to have killed his two-year-old son Tawana Mokwadi Mosinyi on November 27, 2006, at Somerset Extension in Francistown. Morebodi also told the court that he and his colleague had accompanied Fly to the District Commissioner's officer at Ntshe House but never conversed with the accused on the way.

When Fly's lawyer Moabi Madandume put it to him that during the course of the conversation they told Fly to repeat exactly what he told the investigating team, Morebodi denied the allegation. Morebodi also submitted that he did not know how long the former BCP activist was with the investigating team because he was not involved in the investigations. But he told Justice Thomas Masuku that Fly appeared stressed when he was handed to them.

Principal prosecutions counsel Mpho Letsoalo is appearing with prosecution counsels Wanano Ngebani and Game Yuyi. Madandume of Chadwick, Anderson and Partners is the defence counsel. The court is expected to conduct a trial within a trial because the defence is opposing the admissibility of the confession statement made before the judicial officer.
